Why did my trademark get abandoned?
The most common reasons are a missed response deadline to a USPTO office action, failure to file a Statement of Use after an intent-to-use application, or not responding to an examiner's request within the 6-month window. It doesn't mean your brand is gone — in most cases, it can be revived or refiled.
What's the difference between a revival and a reapplication?
If your mark was abandoned less than 6 months ago, we can file a Petition to Revive ($697) which preserves your original filing date and serial number. If it's been longer than 6 months, we file a fresh application ($997) — a clean start with full case management through registration.
Can I do this myself?
Technically, yes. But the USPTO petition process is detail-sensitive — one incorrect form, a missed checkbox, or a wrong classification can delay your case by months or result in another abandonment. We handle hundreds of these filings and know exactly what the USPTO expects.
How long does the process take?
A Petition to Revive typically takes 8–12 weeks from filing to confirmation. A fresh reapplication takes 10–14 weeks. You'll have portal access to track every milestone along the way.
What if the USPTO rejects my petition?
We offer a full refund if the USPTO rejects the filing. Before we start, we review your case to confirm eligibility — we won't take your money if we don't believe the petition will succeed.
